General Terms and Conditions Inside Pleinair Maldemo

That’s what it’s all about:

These conditions apply to all bookings of the online painting demo “Inside Pleinair”, regardless of whether you
a) take part in the live demo,
b) only purchase the recording or
c) book a 20-minute personal Zoom feedback session.

With your booking you accept these terms and conditions.

Registration and payment

You register with me by e-mail, receive an invoice and pay directly via the payment options offered there (PayPal or bank transfer). The participation fee is due immediately. Access to video content and the implementation of feedback services will only take place after full payment has been received and – in the case of digital content – after express consent to the early start of services.

Live mail demo (Zoom) – limited number of participants

Registrations for the live painting demo should be received no later than the Friday before the respective date (in the case of short-term registration, only Paypal as a payment option).

Participation in the booked live appointment via Zoom
– Painting demo to paint along
– Access to the shared pinboard (padlet) and brief personal feedback.
– The recording of the painting demo is included (access for at least 1 year after recording)

Video of the Maldeomo

A recording of the live painting demo can be purchased approx. 2 days later on my website.
After booking by email, you will receive an invoice and access via video link after receipt of payment.
It can be accessed flexibly, but does not include any feedback. The access is valid for at least 1 year after the recording date.
Passing on or publication is not permitted.

Optional: Individual feedback via Zoom

Can be booked in addition to the video, duration approx. 20 minutes.
After booking the feedback, you send me the result of your painting demo and we arrange a Zoom appointment.
During the feedback we discuss your painting individually; you can ask questions and receive specific advice, but there is no fixed appointment at the time the contract is concluded.

Participation and technology

Yours need a stable internet connection for the live painting demo and personal feedback Zoom (free of charge), and a device with a camera and microphone. The live painting demo will be accompanied by a shared pinboard on Padlet.
Please make sure that everything works for you – I cannot provide any technical support. Technical problems on the part of the participants are not my responsibility.

Cancellation

Live painting demo via Zoom:
If you are unable to attend after all, you can cancel up to 24 hours before the start of the course.
I will then retain €5 as a processing fee.
If you cancel later or don’t show up at all, I unfortunately can’t refund anything, you will get the recording of the painting demo and can upload your painting to the pinboard up to 4 weeks after the appointment and get feedback from me.
If I have to cancel the appointment (e.g. due to illness) and no alternative date can be arranged, you will of course get your money back in full.

Cancellation policy

Live painting demo

As the painting demo takes place on a fixed date (§ 312g para. 2 no. 9 BGB), there is no right of withdrawal.
By booking, you agree that you waive your right of withdrawal.

Video painting demo

The video content offered is digital content within the meaning of Section 356 (5) of the German Civil Code (BGB) and is provided immediately upon purchase. The right of withdrawal expires with your consent, which you give at the time of purchase.

Individual feedback via Zoom

There is a right of withdrawal for the feedback service as long as the feedback has not yet been provided.
The right of withdrawal expires once the feedback service has been provided in full.

Copyright

All content and recordings remain my intellectual property.
You may use them for your private use, but please do not share, upload or publish them.
If you show your own work during the Zoom meeting or afterwards, it will of course remain your property.
After the painting demo, a shared digital pinboard (Padlet) can be used where you can voluntarily upload your painted pictures. Please only upload paintings to which you yourself have the rights, and make sure that your comments are respectful and friendly.
I assume no liability for content posted by other participants.
I reserve the right to delete contributions if they are inappropriate or offensive.
By uploading, you agree that your contributions can be seen and commented on.

Use of the contents

All content (video, audio, screenshots, templates, examples) is protected by copyright.
You may use it privately, but not pass it on, publish it, upload it or integrate it into your own courses. Once activated, the video content is available for at least 1 year after publication. Access is personal and may not be passed on to third parties

Liability

I make every effort to ensure that everything runs smoothly. However, I cannot accept any liability for technical problems or failures that you may experience. Otherwise, I am only liable in cases of gross negligence or intent. No guarantee is given for learning success or individual results.

Data protection

I need your billing address and your e-mail address for the booking and registration.
I use this data exclusively to carry out the painting demo, to send you information about the appointment and to issue an invoice.
I do not pass on your data to third parties, unless it is required by law (e.g. for accounting or the tax office). I will ensure that your data is stored securely and protected from unauthorized access.
I will send relevant information about my courses and other painting demos or about your booking to the email address provided.
I do not send automated newsletters and do not pass on your address for advertising purposes.
Occasionally, however, I may contact former participants personally by e-mail if I think that a new course might be of interest to you.
If you don’t want me to do this, just let me know and I will remove you from my mailing list.

You can send me an e-mail at any time if you would like me to delete or correct your data.
Simply write to yomalt@yoruehmer.de.
I will then delete your data, provided there are no legal obligations to retain it (e.g. for invoices).

Zoom

We use Zoom for the live painting demo and feedback.
When you join, your technical data will be processed (name, email address, IP address).
The painting demo will be recorded – but only my camera and the split screen, not your video. Your audio (questions, comments) will also be recorded.
The recording will be sold as a separate video (edited) after the live event. For more information, see point : Supplementary data protection notice – Recording & resale

Vimeo / YouTube (embedded videos)

The recordings are embedded on my website via Vimeo or YouTube.
These providers may set cookies or collect technical data during playback.
I only use unlisted videos that cannot be found publicly.

Recording of the painting demo

The live course will be recorded. The recording only shows my painting demo, my screen, my video and my voice.
Participants are not included in the recording with a painting. Audio (questions and comments) from participants will also be recorded. If you do not wish to appear in the recording, you can leave the microphone deactivated. You will remain anonymous in any case, I may call you by your first name when answering questions.
Publication will only take place as part of the painting demo recording for paying customers (not public, not freely accessible). The feedback round of the live painting demo will be cut out before the video is purchased. Your paintings will therefore only be shown within the round of live painting demo participants.

Use of the recording

The recording of the painting demo will be:
– made available to live participants and
– also sold independently of the live course as a separate recording (“replay”).
By booking the live course, you agree that the recording of the course may also be sold separately at a later date.

Legal basis

The processing and use of the recording takes place on the basis of
Art. 6 para. 1 lit. b GDPR (fulfillment of contract) .

Other

German law applies.
The place of jurisdiction is – as far as permissible – my place of residence.
Should individual points be invalid, the rest of the GTC shall remain valid.
